![]() Topic: Returning after 180 daysPosted: 03 January 2009 at 11:30 |

Hi everyone!
I'm a bit confused, and scared!! :)
I entered BR the last day of June 07
After I got my extension I was supposed to leave on December 28, witch I didn't..
In August 08 I got the FP on my door taking me to their office and fined me for my overstay and gave me 8 days for leaviung the country..
There was no problems with the FP at any time, nice talking and clap on shoulder when I left the office after an hour..
I payed my fine the same day, and when I left the country there was no problem or questions at all.
- I was told that I would be able to enter the country again after 180 days.
But now my girlfriend told me that she's been checking with the FP in another city and they told her that I couldn't reenter for 1 year..???
- And she get panic as well... :)
Is this something new or is it just the way of expression the 180 days/year rule???
- Witch meens I need to stay out of the country for 180 days and then can reenter.
My date of return is set to February 11 and I would appreciate to get some info and advices from you guys before I start getting panic here!!! :)
Thanks to all for helping me!!!!

People in your situation are required to remain outside Brazil for 180 days counting from the day you leave. That would see you eligible to return some time in February. However, that's not to say that an overworked, underpaid FP agent could approve your re-entry sooner without bothering to review your immigration history. These days sophisticated computer scanners tend to do the job for them but some people can still manage to slip back in unchallenged.

- This means, if I understand you right, that there is no new rules about reentering after 180 days.. (?) Which means that I can legaly enter at February 7, since I left at August 11. - Or as I plan, at the 11. Now I hopefully can tell my girlfriend to relax!! :) Thanks for your help!!

Hi I would be interested to know about how the PF found your address? I know many people who overstayed and never once got a knock on the door from the PF. I thought this only happened if you were reported. Any ideas?
As long as you pay the fine or pay on re-entry u wont have a problem after 180 days i shouldnt think. |

Hi! - I would like to know my self!! :) I think someone was reporting me to the FP.. I got some messages that indicated that.. I was never in any trouble with anyone, but as you probably know, there is always someone that don't like your success.. :) But someone knows (!) and that means that we will know as well, - sometime. :) |

sorry to tag onto this thread but i too am a little concerned now after reading your experiences JP
My tourist 180 days is up on the 11 feb..however i had my extra 90 extra days stamped a couple of weeks early and officially i should leave on the 23rd of Jan....im sure all will be ok here when i leave (am happy to pay a small fine) however i only want to leave for a few weeks....i have a brasilian wife and son....and i am hoping to register the marriage and birth with the brasilian consulate in london....we have tried posting but due to xmas are still waiting a response for our "legalised" docs and im now a little panicky....therefore i hope to register my sons birth especially so that i can apply for permanancia through fatherhood of a brasilain...my question is....once i have applied at the consulate in london will i be free to travel back to brazil.....or will i need to wait for the actual visa...if so how long could that take?? also if i buy a ticket and fly in how likley is it that i will be put straight on the next plane back to the uk??
Hope you get back ok JP
Cheers in advance
Iain

Hi Iain!!
You are of course welcome to this tread!! :)
About your time on a tourist visa, it gives you 180 days during a year from the day you arrived. Then you are supposed to stay out of the country for 180 days, from the day you leave.
And the fact that you overstay is as fare as I know, treated with a fine..
- Make sure you pay this before you leave, and take care of your receipt!!!!
It will make everything easier when you enter the country again.
About your questions..
You WILL need your new visa before you can enter the country!
And I'm afraid that they will send you back without that....
- At least they are fully right in doing that.
But, miracle happends.. :)
- If there is anything you are worry about, please use this forum to get help!!! - It gives great help for a lot of us....
Good luck Iain!!

I would have thought it was obvious that you have to wait for the visa (8 weeks more or less). If you have already used up your full 180 day visit visa entitlement and are returning within the same 365 day cycle that began when you first entered Brazil, then you can only re-enter on a different visa status. If you travel without waiting for your family reunion visa it's likely that you will be denied entry (or allowed to enter for only a few days). It's also likely that some sleepy Immigration guard will not bother to check your immigration history and allow you through, but these days computerized passport scanners do the work for them so it's not something worth taking a risk over. |

Hello!
Maybe somebody can give any advice to my situation: I'm stateless person (the person without the country which means I don't have the national passport) with Russian travel document. In December 2008 I have filed my documents to Ministerio de Trabalho e Emprego for the permanent (investor) visa and have already my process running on-line. Now I'm in Brazil on business visa which will be expired on 11th of February 2009. My travel document will be expired also in the end of July 2009. I do NOT wish to pro-long my travel document in Russia that means that by the time my Brazilian visa will be granted (hopefully!) I will no longer have any document to where the visa can possibly be stamped. I don't want to leave Brazil also as I officially invested money and have my company running here and also have nothing connecting me and my country of origin. Can I receive the permanent visa and/or Brazilian travel document here in Brazil without leaving the country? Please advise me what to do in my situation if somebody has an experience or anything reasonable in mind. Thank you. |
