Has anyone sold land or a house by themselves?... without the assistance of a real estate agent. Assuming you have your Escritura Publica and Matricula in order, and that all the taxes (and in this case, condominio dues) are paid and you know someone whom wants to buy the land at an agreed-upon price -- is it as simple as writing a simple contract, collecting funds from a buyer and transferring the deed at the local cartorio?
If the condominio is administered by a property management company, do they have to be included in the process?... or just notified when the deed has been transferred. If one does use the services of a real estate agent, what are they paid in the manner of fees and/or commission? Thanks...

Yes sure, what elses do you need? If you are sure to get your money. That´s it! Usually the buyer makes a down payment (SINAL) and the other payments are decribed and arranged in the CONTRATO DE VENDA E COMPRA DE IMÓVEL, including dates or timeframe. Have that contract drafted by a CARTÓRIO and registered. The transfer of the ESCRITURA and REGISTRO DE IMÓVEL will be done accoring to the arrangements in the contract. Usually once the buyer paid the whole amout. But that depends, if you trust him 100% and you´re sure to get your money. You can do the transfers even before the last payment. ![]() |

By all means, attempt to sell it yourself first! Yet being the seller, the greater onus will be on you to get the appropriate certidões negativas, based on you, and the land (mostly based on you oddly, and not the piece of RE). If your spouse is listed as co-owner, then CN's on her too. The cartorio where you'd do the closing/escritura should have a list of what's necessary, but if not, let me know, and I can post it. But the bottom line is, as MA stated, "show me the money!" Once you know the buyer is good for the deal, it should be quite smooth. I don't know for sure if the property mgmt company needs to be included, but I can't see why they should be. As for as RE commissions, on the island things are more regulated and on the up and up (sort of), and are 6%, or perhaps a bit more, depending on what you're selling, and where. Download the table at this site for more info on what they might be for SC: sindimoveis-sc.org.br Yet what I encountered when doing a deal in the serra recently is this kinda scam... the owner goes to a Realtor, and tells them what he'd like for his RE, say 100K. The Realtor then lists the RE for whatever they like, say 130K, and then if it sells, the owner gets his 100 and they keep the rest! Bem liso!!! So depending where your RE is located, you might encounter this sort of game, if using an agent. But AFIK, things listed on island are more specifically tied to formal commission percentages.
