How is that BS? Sven said (correctly) that you have to marry where AT LEAST one of you has proof of address. You married where your fiance lived. @deanwatt - If two people are living in the NE and they are from SP and want to go back to SP to get married and have all the time to register intent and hang around without needing to go back (improbable) then they likely could use a family member's proof of address. They would more likely marry civilly in the NE and then have a religious ceremony with family, friends, etc. in SP, as the two events are seperate. Civil marriage in big city Brazil often means going into a big room, literally lining up behind several other couples - saying yes to the judge and signing a paper in front of her and then having her sign and hand you a different paper before someone pushes you out the door so the couple behind you can sign their paper. There is generally no room for a whole lot of witnesses beyond the required padrinhos (who usually dress in jeans and tee-shirts) and not much of a romantic atmosphere. If I remember correctly, when I registered intent to get married the proof of address was in my sogra's name. She signed a letter in the cartorio saying that we lived with her at that address. Proof of address is one of the many items on the list of requirements that they won't bend. |

I just got back from the Registro Civil where my finance and I registered all of our documents to get married. My visa has not expired, but I ended up asking about the issue of expired visas, and the women at the Registro stated that they don't look for a valid visa for foreigners who want to get married to Brazilians. They were instructed it's actually not their business to ensure a valid visa; a judge instructed them that this has to do with the federal police, not the Registro.
I also visited the federal police today to get documents on how to apply for permanent residency AFTER we are married. The first sentence on the list of documents given to me by the PF reads, "Faça o pedido dentro do prazo de estada. Após o vencimento do prazo será aplicada uma multa de R$8,28 por dia até o limite de R$827,75." So, I take this to mean that the PF here in Curitiba, Paraná is used to having foreigners marry and ask for permanent residency with expired visas. You might want to try your luck down here, but not sure how you'd get around the issue of proving residency (i.e. where you live), because we are marrying at the Registro Civil which has jurisdiction over my address. Also, I can help you find a room to rent if you want to come down for a few months just to try and marry here. In fact, the woman who I rent my apt from has rooms that she rent's out, so you'd be covered ie proof of address and marrying at this specific cartorio (which I don't want to mention on this list...call me at 41.9892.7909 if you want the name and address). In fact, she signed our declaration of residence.

IsaKen: Thanks for the info. You're the 2nd person that told me that Curitiba, Paraná is a good option for finding a cartario that will follow the constitution and laws of brazil and complete the marriage.

Does anyone have more information about the cartorio in curitiba?
I was just replied that "will not give you informations about where I married because Im afraid it might get in the way of my visa process" Cmon guys is not like telling other people where you married is illegal, i guarantee you police does not care about that, is no top secret information. Quite upset about getting that answer I thought that maybe Id finally get my marriage done but no, no help on the way.. |
